Limitation of Liability

1. Content Offered Online
odelo GmbH offers no warranty of any kind as to the currency, accuracy, completeness or quality of provided information. odelo GmbH is not liable for loss or damage, whether tangible or intangible, resulting from the use or nonuse of the provided information, or from the use of erroneous or incomplete information, unless odelo GmbH is demonstrably at fault for willful misconduct or gross negligence. All offers are subject to change without notice and nonbinding. odelo GmbH expressly reserves the right to change, add to or delete part or all of this site without notice, or to discontinue it temporarily or permanently.

2. Referrals and Links
In the case of direct or indirect referrals to outside Web sites (“hyperlinks”) lying outside the sphere of responsibility of odelo GmbH, liability will be incurred solely in the event that odelo GmbH is aware of their content, and is technically able and can reasonably be expected to prevent the use of those sites if their content is contrary to the law. odelo GmbH hereby expressly declares that as of the date when the links were established, the linked sites had no recognizable illegal content. odelo GmbH has no influence of any kind over the current or future design, content or ownership of the linked sites. For that reason it hereby expressly dissociates itself from any content of linked sites that has been altered since the links were established. This disclaimer applies for all links and referrals established within odelo GmbH’s own Web site, and for entries posted by third parties within guest books, discussion forums, link lists and mailing lists set up by odelo GmbH, as well as all other forms of databases that may be accessed by outsiders to add content. Any illegal, erroneous or incomplete content, and particularly any loss or damage resulting from the use or non-use of such information, is the sole responsibility of the provider of the site to which the link was established, not the party who merely refers to such a publication by way of links.

3. Copyright and Trademark Rights

All trademarks mentioned on this Web site, including those protected by third parties, are subject without limitation to the provisions of the applicable trademark rights and the ownership rights of their registered owners. A mere mention cannot be construed as an indication that a trademark is not protected by a third party’s rights. odelo GmbH reserves the sole copyright for published content produced by odelo GmbH itself. Such graphics, sound documents, video sequences and texts may not be reproduced or otherwise used in other electronic or print publications without the express consent of odelo GmbH.

4. Data Privacy
Where this Web site offers opportunities to input personal or business data (Email addresses, names, addresses), these data are disclosed by the user expressly on a voluntary basis. So far as is technically feasible and can reasonably be expected, all offered services may also be used and paid for without providing such data, or by providing anonymized data or a pseudonym. Contact data published in the production information for this site, or any disclosures comparable to such data, including but not limited to mailing addresses, telephone and fax numbers, or Email addresses, is not to be used by third parties to send information that has not expressly been requested. We expressly reserve the right to take legal action against senders of “spam” e-email if this prohibition is violated.

5. Legal Validity of this Liability Limitation
This liability limitation is to be considered a part of the Web site that links to this page. If portions or individual passages of this text are not in conformity, no longer in conformity, or not fully in conformity with the current status of the law, the content and validity of the remaining portions of the document shall be unaffected thereby.
